{"id":1098,"date":"2026-07-08T14:04:40","date_gmt":"2026-07-08T12:04:40","guid":{"rendered":"https:\/\/kanzleifueralle.de\/?p=1098"},"modified":"2026-07-30T21:28:46","modified_gmt":"2026-07-30T19:28:46","slug":"rechtstipp-1-polizeikontrollen-bei-der-fusion","status":"publish","type":"post","link":"https:\/\/kanzleifueralle.de\/en\/2026\/07\/08\/rechtstipp-1-polizeikontrollen-bei-der-fusion\/","title":{"rendered":"Legal tip #1: Police checks during the merger\u00a0"},"content":{"rendered":"<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Festival summer means heat, little sleep, and cramped tent living.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">However, festival summer also means unforgettable acts, time spent with friends, solidarity, freedom, and lasting inspiration.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone who has travelled to Fusion or another large festival before will also know the downside: police checks are now almost a standard part of arrival and departure in many places (\u201eblue zone\u201c).<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">To ensure that a carefree festival weekend doesn't lead to unnecessary legal repercussions, it's worth knowing your rights and obligations.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">While the following guidance does not replace individual legal advice, it provides an overview of the most important principles for dealing with police checks.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The golden rule: Never drive under the influence of alcohol or drugs!<\/strong><\/h3>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">It's a given: anyone who drives a vehicle under the influence of alcohol or other drugs not only endangers themselves but also other road users.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, there are severe legal consequences. From fines and criminal investigations to the loss of your driving licence.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">A driver is considered to be any person who consciously steers or operates a device for locomotion, i.e. a vehicle (bicycle, car, e-scooter etc.).<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone who has any doubts about their fitness to drive should always arrange for a sober driver, book a \u2018Clean Driver\u2019 service or use public transport.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Tip No. 1: Remaining silent is a right and often the wisest decision<\/strong><\/h3>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">A principle that criminal defence lawyers have preached for a long time is: You generally have no obligation to make statements about the matter to the police.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">You only have to<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to state your personal details,<\/li>\n\n\n\n<li>your driving licence, as well as<\/li>\n\n\n\n<li>Show the vehicle documents.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, you are not obliged to answer questions.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, you should not make any statements regarding possible alcohol or drug consumption (neither current nor past consumption).<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Even seemingly harmless comments can later be used as incriminating evidence. Statements about regular or repeated use, for example, can make it easier to justify further investigative measures.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Even the conversation with the police can form part of the evidence-gathering process. Police officers are trained to identify clues that may lead to further action.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Factual and polite replies such as \u201eI do not wish to comment on that\u201c are entirely sufficient and do not put you at any legal disadvantage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Tip No. 2: Do not voluntarily legitimise coercive measures<\/strong><\/h3>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Mere attendance at a festival does not establish reasonable suspicion and does not justify further intervention.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">As part of general traffic checks, the police are authorised to stop and check drivers. In the case of pedestrians and passengers, their powers are, in principle, limited initially to establishing their identity.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The police must issue separate orders for any further measures (e.g. searches or blood tests) and state the grounds for them.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">It may only do so where there are specific grounds for suspecting that criminal offences or administrative offences have been committed.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">If the police believe these exist, the following can be ordered in particular:<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in relation to drivers: a blood sample (cf. \u00a7 81a para. 2 no. 2 StPO) and, if applicable, a search,<\/li>\n\n\n\n<li>potentially a search of pedestrians or fellow passengers.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Where appropriate measures are ordered, the following applies:<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Express your objection to the measure clearly, but politely.<\/li>\n\n\n\n<li>Do not offer any physical resistance.<\/li>\n\n\n\n<li>Do not sign any statements or declarations.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Whilst a verbal objection does not usually prevent the measure from being taken, it does serve to document that it is not being carried out with your consent.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Tip No. 3: Voluntary means voluntary<\/strong><\/h3>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">A common misunderstanding is that those affected believe they have to justify why they refuse certain tests.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The opposite is true: If the police wish to interfere with fundamental rights, they require a legal basis for this authorization. If the prerequisite for these authorization grounds is not met, participation in many measures remains voluntary.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">These include in particular<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Breathalyser tests,<\/li>\n\n\n\n<li>Drug screening tests using saliva, urine, or sweat samples,<\/li>\n\n\n\n<li>Coordination and balance tests, as well as other behavioural tests.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Particularly when the legal conditions for a compulsory order are not met, police officers often try to obtain voluntary consent.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Such statements do not alter the fact that voluntary measures remain, by their very nature, voluntary. If there is already reasonable suspicion, your consent is generally no longer required in any case.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the advice is: remain friendly, respectful, and calm. However, refrain from voluntary tests if you do not wish to undertake them.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-style:italic;font-weight:400\">This post is for general information only and does not constitute legal advice.
